MOLEKULE® LONGEVITY SWEEPSTAKES 2026 OFFICIAL RULES (“RULES”)

• NO PURCHASE IS NECESSARY TO ENTER OR WIN.

• A PURCHASE OF ANY KIND DOES NOT INCREASE YOUR CHANCES OF WINNING.

• ENTRANTS TO THE SWEEPSTAKES WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

BY ENTERING (OR OTHERWISE PARTICIPATING IN) THE SWEEPSTAKES, YOU AGREE TO THESE RULES, WHICH ARE A BINDING CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE SWEEPSTAKES PARTIES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

1. ELIGIBILITY: The Molekule Longevity Sweepstakes (the "Sweepstakes") is open only to legal residents of the forty-eight (48) contiguous United States and the District of Columbia, who sign up at the online Sweepstakes page [https://molekule.com/longevity], and who are eighteen (18) years of age or older and are of the applicable legal age of majority as of date of the Sweepstakes entry. Employees, officers, and directors of Molekule Group, Inc., a Delaware corporation (“Sponsor” or “Molekule”) and KickoffLabs LLC, a Washington limited liability company (“Administrator”) and its/their respective parent companies, affiliates, subsidiaries, advertising, contest, fulfillment, and marketing agencies (collectively, the “Sweepstakes Parties”), their immediate family members, and those living in the same household as such individuals (whether legally related or not), are not eligible to participate in the Sweepstakes or win the “Prize” (as defined in Section 8 of these Rules). For purposes of the Sweepstakes, “immediate family members” are defined as spouse, partner, parents, legal guardians, in-laws, grandparents, siblings, children, and grandchildren, and their respective spouses, and “those living in the same household” shall mean people who share the same residence at least three (3) months a year, whether legally related or not.

In the event that a household, based on address, enters Sweepstakes using more than five (5) unique email addresses, all of the Sweepstakes entries associated with that household (determined by Sponsor or Administrator at their sole discretion) will be disqualified. The Sweepstakes is void in Alaska, Hawaii, all US Territories, and where prohibited by law. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. By participating in the Sweepstakes, you unconditionally accept and agree to comply with and abide by these Rules and the decisions of Sponsor, including Sponsor’s interpretation and application of these Rules, administration of the Sweepstakes, selection of the winner, Sponsor’s exercise of discretion, which will be final, non-appealable, and binding in all respects.

2. AGREEMENT TO SWEEPSTAKES RULES: In addition to the above, by participating in, entering, or otherwise signing up for, the Sweepstakes, you (i) agree to be fully unconditionally bound by these Rules, (ii) represent and warrant to Molekule that you meet the eligibility requirements set forth in the Rules, (iii) agree to accept the decisions of Molekule, as final and binding as it relates to the Sweepstakes, your participation in the Sweepstakes, and the compliance with, interpretation of, and application of the Rules, and (iv) agree the Sweepstakes is subject to all applicable federal, state, and local laws and regulations.

3. SWEEPSTAKES PERIOD AND TIMING: The Sweepstakes begins at or about 12:01 a.m. Eastern Time (“ET”) on August 18, 2026, and ends at 11:59 p.m. ET on November 16, 2026 (the “Sweepstakes Period”). Entries will be accepted online only during the Sweepstakes Period. The designated computer clock of the Sponsor is the official time-keeping device in the Sweepstakes.

4. HOW TO ENTER: During the Sweepstakes Period, click on https://Molekule.com/Longevity (the “Sweepstakes Page”) and complete and submit an official entry form, including your valid and correct email address. You can also reach the Sweepstakes Page by visiting Molekule.com (the “Website”). Your entry must fulfill all Sweepstakes requirements, as specified, to be eligible to win the Prize. Entries that are not complete or do not adhere to the Rules may, at the sole discretion of Molekule, be disqualified. You must accurately and truthfully fill in all the requested Sweepstakes entry information. Upon receipt by Sponsor during the Sweepstakes Period of your properly completed Sweepstakes entry form including your valid and correct email address (the “Entry Form”), then, subject to the Rules, you are an official entrant in the Sweepstakes (“Entrant”). While you may not enter the Sweepstakes more than once, as an Entrant you become eligible to receive additional bonus entry opportunities (as discussed immediately below). You may not use multiple e-mail addresses, identities, devices, or other methods that attempt to circumvent the Rules. If you use fraudulent methods in connection with your entry into the Sweepstakes, or otherwise attempt to circumvent the Rules, your entry submission(s) may, at the sole discretion of Molekule, be removed from eligibility consideration.

Entrant Sweepstakes Bonus Entry Opportunities

After becoming an Entrant, you will then be presented on the Sweepstakes Page with the opportunity to receive additional Sweepstakes entries from the Sponsor as follows:

Entrant Telephone Number Bonus Entry: An Entrant who provides their valid text-enabled telephone number by clicking on the telephone number link on the Sweepstakes Page and entering their qualifying telephone number will receive fifteen (15) bonus entries into the Sweepstakes (“Telephone Bonus Entry”). Limit one (1) Telephone Bonus Entry award per Entrant. Using an incorrect, invalid, or another person’s telephone number is a violation of these Rules, and your Sweepstakes entry submission(s) may, at the sole discretion of Molekule, be removed from eligibility consideration.

Entrant Successful Referral Bonus Entries: An Entrant is also eligible to receive fifteen (15) bonus entries into the Sweepstakes for each person they refer to the Sweepstakes that validly enters the Sweepstakes using Entrant’s unique referral link (“Sweepstakes Referral Link”). You can obtain your Sweepstakes Referral Link on the Sweepstakes Page by clicking the designated Sweepstakes Referral Link prompt, which is available after your completed entry to the Sweepstakes. A "successful referral" occurs when an eligible person enters the Sweepstakes by clicking on Entrant’s Sweepstakes Referral Link and completes a valid entry into the Sweepstakes (“Referral Bonus Entry”). There is no limit to the number of Referral Bonus Entry(s) that an Entrant may receive during the Sweepstakes Period.

Entrant Eligible Product Purchase Bonus Entries: An Entrant is also eligible to receive fifteen (15) bonus entries into the Sweepstakes for each “Eligible Product Purchase” made by them, using the previously submitted Entrant email address, prior to the expiration of the Sweepstakes Period (“Product Purchase Bonus Entry”). There is no limit to the number of Product Purchase Bonus Entry(s) that an Entrant may receive during the Sweepstakes Period, however all Product Purchase Bonus Entries awarded to Entrant for product subsequently accepted for return under the Molekule 30-Day Refund Policy shall be cancelled, voided, and no longer eligible as an entry in the Sweepstakes.

Each of the following constitutes an Eligible Product Purchase: 

  • Entrant’s purchase of Glow humidifier (SKU FRN-US) made on or after August 17, 2026 and before expiration of the Sweepstakes Period;
  • Entrant’s purchase of PECOAir™ purifier (SKU CD1-TPH) made on or after October 20, 2026; and
  • Entrant’s purchase of PECOAir+™ purifier (SKU CD2-TPH) made on or after October 20, 2026.

The Telephone Bonus Entry, Referral Bonus Entry and the Product Purchase Bonus Entry are individually and collectively referred to as the “Bonus Entries.”

The Sweepstakes Parties are not responsible for technical difficulties, glitches, bugs, failures, or viruses in server hardware or software, transmission line failures, or for lost, delayed, or corrupted data transmitted by Sweepstakes participants, or for website accessibility, hosting, or operation, of any kind. The Sweepstakes Parties are also not responsible for false, incorrect, changed, incomplete or illegible contact information of any Entrant or potential Entrant. Sponsor is not responsible for Sweepstakes entries made but not received and/or accepted, and all such entries are void.

5. SWEEPSTAKES ENTRY LIMIT: Subject to the Rules for receipt of additional Bonus Entries, you are only allowed to submit one Entry Form to enter the Sweepstakes, and only through the Sweepstakes Page. Attempts made by you (acting alone or in concert with others) to (i) submit more than one Entry Form or (ii) use multiple or false contact information, accounts, or other improper methods to obtain Sweepstakes entries, may, in the sole discretion of Sponsor, result in your and anyone acting in concert with you disqualification from the Sweepstakes. Sweepstakes entries generated by a script, computer program, macro, programmed, robotic, or other automated means are void. Sweepstakes entries that are in excess of the applicable stated limits in these Rules, incomplete, illegible, corrupted, lost, forged, false, misdirected, deceptive, or otherwise not in compliance with the Rules, may, in Sponsor’s sole and absolute discretion, be disqualified from the Sweepstakes. Those that do not follow all instructions for the Sweepstakes, or fail to provide the required information in their Entry Form, or fail to abide by the Rules, may, in Sponsor’s sole and absolute discretion, be disqualified from the Sweepstakes. Sweepstakes entries submitted by those who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void.

6. SWEEPSTAKES DRAWING: On or about December 21, 2026, the Administrator will conduct a random drawing to select one (1) potential winner from among all eligible Sweepstakes entries received in accordance with these Rules.

7. ODDS: Odds of winning the Prize depend on the total number of all eligible Sweepstakes entries under the Rules received during the Sweepstakes Period.

8. SWEEPSTAKES PRIZE AND RESTRICTIONS: The “Prize” eligible to be awarded in the Sweepstakes to the Sweepstakes winner are collectively as follows:

All trademarks, service marks, trade names, product names and logos appearing in these Rules are the property of their respective owners. Other than Molekule®, PecoAir™, PecoAir+™, and Peco-HEPADVANCED™, the use of any third-party trademark or name is solely for the purpose of identifying the Prize and does not imply any sponsorship, endorsement or affiliation with the Sweepstakes and, all such brands and owners, are not sponsors of, and are not affiliated, with the Sweepstakes in any way. The Sponsor of this Sweepstakes is Molekule Group, Inc. and any communications by you can be sent to support@molekule.com. 

You are not guaranteed to win the Prize and your chance of winning is dependent on the total number of all confirmed eligible Sweepstakes entries issued during the Sweepstakes Period. The Prize is non-transferable, with no cash redemptions, equivalents, or substitutions, except at Sponsor’s sole and absolute discretion. All Prize details not specified in these Rules will be determined in Sponsor’s sole and absolute discretion. Limited sizes may only be available. If Winner’s requested size(s) are unavailable, Sponsor will provide, in its sole discretion, the closest available size. Prize details and availability are subject to change and are subject to applicable rules and restrictions. In the event that Sponsor is unable to provide a Prize or Prize component, the Sponsor can elect to provide winner with the approximate value of such item in cash or award an alternate prize of approximately comparable or greater value.

The Prize is awarded to the winner “AS IS” and without warranty or guarantees of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose) by, or from, the Sweepstakes Parties. The Sweepstakes winner is solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the Prize received, regardless of whether the Prize, in whole or in part, is used by such winner. The value of the Prize will be reported for tax purposes by Sponsor as required by law. As further provided in Section 9 of the Rules, the Sweepstakes winner will be required to provide Sponsor with a valid social security number and to complete and return a Form W-9 (for U.S. tax reporting purposes) prior to any Prize fulfillment. In addition, an IRS Form 1099 will be issued in the name of the winner for the actual value of the Prize received.

The Sweepstakes Parties are not responsible for, and will not replace, any lost, mutilated, or stolen Prize, or any Prize that is undeliverable or does not reach the winner because of an incorrect or changed address. Prize delivery is limited to the forty-eight (48) contiguous United States and the District of Columbia. If the Sweepstakes winner does not accept or use the entire Prize, the unaccepted or unused part of the Prize will be forfeited, and the Sweepstakes Parties will have no further obligation with respect to that Prize or portion of the Prize.

The approximate retail value (“ARV”) of the Prize, including (where applicable) installation, shipping, and sales tax, is approximately $20,000. The actual value of the Prize, however, may vary depending on your location, market conditions, date of manufacture, model no., selected size, season, tariffs, holidays, logistics and delivery. Actual ARV may differ at time of Prize award. Any difference between the ARV and value of the Prize received will not be awarded to you.

9. SWEEPSTAKES WINNER SELECTION, REQUIREMENTS, AND NOTIFICATION: Potential winners are subject to verification by Sponsor, whose decisions are final and binding in all matters related to the Sweepstakes. You are not a winner of the Prize unless and until your eligibility has been verified, you have timely completed the Required Documentation (defined below), and you have been notified in writing by Sponsor that your verification is complete and Required Documents are accepted.

The potential winner of the Sweepstakes will be selected in a random drawing under the supervision of the Sponsor. Following such Sweepstakes selection, the Sponsor will attempt to notify such potential winner by email, using the potential winner’s email address provided in the selected Sweepstakes entry, within seven (7) days following such selection. If the potential winner cannot be contacted, verified, or confirmed after two (2) such attempts (and further attempts, if any, at Sponsor’s sole and absolute discretion), a Prize is declined, the potential winner is not eligible for award of a Prize for whatever reason, or if the potential winner otherwise fails to fully comply with these Rules, the potential winner will forfeit the Prize, and an alternate potential Sweepstakes winner will then be randomly selected by Sponsor from all remaining eligible Sweepstakes entries. Up to three (3) alternate potential Sweepstakes winners will be contacted after which the Sweepstakes prize will be un-awarded and deemed forfeited.

As part of the Sweepstakes winner’s eligibility and verification process, the potential Sweepstakes winner will be required, within fourteen (14) days of Sponsor’s email notification, to: (i) complete, execute, and return to Sponsor an affidavit of eligibility under penalty of perjury providing proof of identity, address, and age, along with a declaration of compliance with the Rules, in the form and content provided by Sponsor (“Affidavit”); (ii) complete, execute, and return to Sponsor a proper Form W-9 for tax reporting purposes (“W-9”); (iii) complete, execute, and return to Sponsor a Prize redemption form in the form and content provided by Sponsor (the “RedemptionForm“); (iv) execute and return to Sponsor a comprehensive liability waiver and publicity release, in the form and content provided by Sponsor, (“Release Agreement“), and (v) such other documents as reasonably requested by Sponsor as a condition precedent to receiving the Prize (collectively items (i) through (v) the “Required Documentation”).

If the potential winner fails or refuses to provide the Required Documentation within the required time period, or if the Required Documentation is returned as rejected, faulty, unclaimed or undeliverable to the potential Sweepstakes winner, then such potential winner will be disqualified from the Sweepstakes and an alternate potential Sweepstakes winner will be selected. All activity arising out of and relating to the Sweepstakes is subject to verification and auditing for compliance with the Rules, and the Sweepstakes potential “winner“ agrees to reasonably cooperate with Sponsor concerning such verification and auditing.

The Sweepstakes Parties are not responsible, and shall not be liable, for incorrect, changed, inaccurate, non- functioning, or false contact information, or for electronic communications that are undeliverable as a result of any form of active or passive filtering settings, or insufficient space in entrant’s email system. The Sweepstakes Parties are not responsible for late, lost, intercepted, misdirected (e.g., spam, junk, or other related non-inbox folders), or unsuccessful efforts to notify the potential Sweepstakes winner. Notification by the Sweepstakes Parties to you is deemed to have occurred immediately upon the sending of an email to you using the email information provided in your Sweepstakes entry.

No more than one (1) Prize will be awarded. If, for any reason, more bona fide winners (as determined in the sole discretion of Sponsor) come forward seeking to claim the Prize, the winner may be selected in a random drawing from among all persons making purportedly valid claims. Inclusion in such drawing shall be each Entrant’s sole and exclusive remedy under such circumstances. In the event of a dispute as to the identity of an Entrant, the authorized account holder of the email address associated with the entry will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an internet service provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the email address.

The receipt by the potential winner of the Prize offered in this Sweepstakes is, in addition to compliance with all Rules and Sweepstakes requirements, conditioned at all times upon that selected potential winner’s compliance with any and all applicable federal and state laws and regulations, as well as any applicable federal, state or local tax requirements. ANY VIOLATION OF THESE RULES BY ANY POTENTIAL WINNER OR WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY VOIDED, TERMINATED, AND FORFEITED.

10. Rights Granted by you: Subject to applicable law, the Sweepstakes winner, without any further consideration (monetary or otherwise), hereby expressly grants to the Sponsor and its respective successors, assigns, sublicensees and designees, the irrevocable right to use and publish the winner’s name, social handles, likeness (photographic or simulated), voice, biography, and city and state of residence, for all purposes, including, without limitation, advertising, marketing, news, trade, public relations, promotional and publicity purposes in connection with this Sweepstakes (“Advertising”), in any and all media now or hereafter devised, worldwide, in perpetuity, without any form of notice, permission or any amount or kind of compensation, except for the awarding of the Prize to the winner. All copyright, trademark or other intellectual property rights in such Advertising shall be owned by Sponsor and/or its licensors, and Sweepstakes winner hereby disclaims and waives any claim of right to such Advertising. Such Advertising shall be solely under the control of Sponsor and/or its licensors, and the winner hereby waives any claim of control over the Advertising content as well as any possible claims concerning the use of winner’s name, likeness or voice under contract, tort or any other theory of law.

11. General Conditions: In the event Sponsor is prevented from continuing with the Sweepstakes by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Sweepstakes by any party or any federal, state, or local government law, order, or regulation, order of any court or jurisdiction, or if any fraud or other problem beyond Sponsor’s direct control corrupts or interferes with the administration, integrity, operation, security, or proper play of the Sweepstakes as determined by Sponsor in its sole discretion, or any other cause not reasonably within Sponsor’s control (each, a “Force Majeure” event or occurrence), Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes or Prize. In such event, Sponsor reserves the right, but not the obligation, to select a Sweepstakes winner in a random drawing of the eligible entries received up to the time of such Force Majeure event/occurrence or Sponsor’s identification of the impairment.

Sponsor reserves the right in its sole discretion to disqualify any individual it finds or believes to have tampered, or is tampering, with the Sweepstakes entry process, the operation of the Sweepstakes, or to have acted or be acting in violation of these Rules or otherwise in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Rules will not constitute a waiver of that provision. All references to an Entrant’s status as a “potential winner” or “winner” are subject to Sponsor verification and auditing. If verification activity or an audit evidences non-compliance of a Sweepstakes entry or Entrant with the Rules as determined by Sponsor in its sole discretion, Sponsor reserves the right to disqualify the Entrant and/or Sweepstakes entry and remove the Entrant and/or Sweepstakes entry from the Sweepstakes at any time.

By participating in the Sweepstakes, you further acknowledge and agree that all information and material, including any personal information provided in your Sweepstakes entry materials, affidavits, and releases, may be used by, and/or shared with, Sponsor's agents, representatives, and other third parties that are involved: (i) in the execution, verification, administration, auditing, enforcement, or hosting of the Sweepstakes, (ii) in complying with applicable laws, regulations and rules, (iii) in the publication, promotion, and/or release for promotional purposes, and (iv) in compliance related activities and communications. In the event of any discrepancy between the Sponsor’s Privacy Notice and these Rules, these Rules shall control and govern.

12. CONSENT TO RECEIVE SPONSOR NEWSLETTERS, TEXTS, AND MARKETING COMMUNICATIONS. By entering the Sweepstakes, you agree to receive Molekule email newsletters, promotional communications (email and texts), product offerings, and other marketing materials periodically from Molekule. You can subsequently opt-out of receiving such communication at any time by clicking the unsubscribe link in the newsletter, email, text, or other communication.

13. DISCLAIMERS: The Sweepstakes Parties assume no responsibility or liability for: (a) lost, late, stolen, undelivered, inaccurate, incomplete, delayed, misdirected, damaged or garbled registrations, entries, URLs, or emails; (b) any incorrect or inaccurate entry information, or any faulty or failed electronic data transmissions; (c) any unauthorized access to, or theft, destruction or alteration of entries or registrations at any point in the operation of this Sweepstakes; (d) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, cable, satellites, servers, computers or providers utilized in any aspect of the operation of the Sweepstakes; (e) inaccessibility or unavailability of the Internet, Sweepstakes Page, or the Website or any combination thereof or for computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, social networking posts, or registrations, the announcement of the Prize, or in any other Sweepstakes-related materials; or (f) any injury or damage to Entrants or to any other person's computer which may be related to or resulting from any attempt to participate in the Sweepstakes.

14. RELEASES: All Entrants, as a condition of participation in this Sweepstakes, release, discharge, indemnify and hold harmless the Sweepstakes Parties and each of their respective directors, officers, employees, agents, subsidiaries, successors and assigns (collectively, “Released Parties”) from and against any and all liability, claims, costs (including attorneys’ fees), losses, damages, fines, or actions of any kind whatsoever for injuries, death, damages, or losses to persons or property, which may occur or be sustained, in whole or in part, directly or indirectly, whether caused by negligence or not, from or in connection with: (i) participation in any aspect of the Sweepstakes; (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the receipt, ownership, installation, use, misuse, maintenance, storage, location, relocation, and/or technology of any element, portion, or component of the Prize awarded and/or received, including any travel (when applicable) associated with any such Prize; (iv) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (v) the unauthorized human intervention in any part of the Sweepstakes entry process; (vi) Sweepstakes winner’s registration information on any Prize brand website or related department or database, and/or (vii) any typographical, human, or other error, in the printing, offering, selection, operation or announcement of any Sweepstakes winner, entry, activity, and/or Prize.

15. GOVERNING LAW AND LIMITATION OF LIABILITY: As a condition of participating in the Sweepstakes, you/ Entrant agree that any and all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of you/Entrant, Sponsor, or the Released Parties in connection with the Sweepstakes, will be governed by and construed in accordance with the internal laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws. Any controversy arising out of, or relief sought pursuant to, the Rules and/or relating to the Sweepstakes shall be exclusively filed in a state or federal court residing in Palm Beach County, Florida, United States of America, and the Parties hereby waive any right to challenge the jurisdiction or venue of said courts.

AS A CONDITION OF PARTICIPATING IN THE SWEEPSTAKES, ENTRANT/YOU AGREE THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED FIVE HUNDRED DOLLARS ($500.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE BY EITHER YOU/ENTRANT OR THE SWEEPSTAKES PARTIES; (C) UNDER NO CIRCUMSTANCES WILL YOU/ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND YOU/ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED FIVE HUNDRED DOLLARS ($500.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) YOUR/ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND YOU/ENTRANT IRREVOCABLY WAIVE(S) ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU/ENTRANT.

16. MISCELLANEOUS: The invalidity or unenforceability of any provision of these Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Rules will not constitute a waiver of that provision. Entrant(s) agree to waive any rights to claim ambiguity of these Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials, privacy policy, or terms of use on any website, social media platform or application, and/or the terms and conditions of the Rules, the Rules shall prevail, govern, and control.
